Users that use the Services to post creative work on the Website on behalf of themselves are referred to in this Agreement as, "Freelance Users" and individuals who access and use the Services on their own behalf and/or on behalf of an entity to locate Freelancers and engage them to perform services are referred to as “Clients” or “Client Users.” If you use the Services on behalf of an employer, organization, or other entity, then (a) "you" includes you and that entity, and (b) you represent and warrant that you are an authorized representative of the entity with the authority to bind the entity to this Agreement, and that you agree to this Agreement on the entity's behalf.

If you access the Services through a social networking site, you agree that we can access, store, and make available on the Services, any information and data that you provide in your applicable social networking site account such that the same information is available in your User account. You agree that we are not liable for any personal information that is made available to us in violation of your privacy settings with the applicable social networking site. By providing us your email address you consent to our using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by mail. We may also use your email address to send you other messages, such as changes to features of the Service and special offers. Only those Freelancers who have been approved by the Company will be included in the marketplace and the Company reserves the right to decide, in its sole discretion, on who will be included the in the marketplace. The Company reviews such factors as quality of creative work, work experience, and experience with a recognizable brand, among other factors.
The Website and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by the Company, its licensors or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. This section does not apply to User Contributions; however, if you provide feedback and related materials to us concerning the functionality and performance of the Services or the Website, including identifying potential issues, improvements, modifications, or enhancements (“Feedback”), you hereby grant to us a nonexclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right and license to make, use, sell, sublicense, reproduce, distribute, perform, display, prepare derivative works from and otherwise exploit all such Feedback for any purpose without restriction.
